GENERAL:
This AGREEMENT is binding between MINISTRY OF PIANO and YOU (hereinafter refer to as USER)
OVERVIEW:
MINISTRY OF PIANO is a platform wherein USERS can be able to post their item for sale on the website and purchase item(s) from other USERS. Agreement upon USERS is a separate contract formed between them.
OBLIGATION AND TERMS:
YOU agree to be bound to observe the following rules of conduct:
- Do not post anything that is knowingly false, defamatory, profane, vulgar, obscene, threatening, abusive, hateful, racially offensive, pornographic, embarrassing or that has any potential to cause any harm or damage to anyone as determine by MINISTRY OF PIANO in its sole discretion
- Do not post any illegal items/products/services
- Do not infringe upon third party copyright, nor invade the privacy or publicity rights of others
- Do not post anything protected by copyright without the permission of the copyright owner.
- Do not post any misrepresentation and misleading descriptions and representations to advertise or sell, rent, exchange or free.
REVIEW:
MINISTRY OF PIANO has no obligation to and does not in its normal course, prescreen, monitor or review all the materials posted online. MINISTRY OF PIANO does not exert editorial control over all posts of services. MINISTRY OF PIANO reserves the right to prescreen, monitor and/or review all services and hiring posted and suspends access as MINISTRY OF PIANO may deem appropriate.
MINISTRY OF PIANO reserves the right to disclose any information to satisfy any legal, regulatory or governmental request. In its sole discretion, MINISTRY OF PIANO reserves the right to refuse to post or remove a post (“post” may include ads and services), but due to the real time nature of postings, it is impossible to pre-screen, review or monitor every post.
Any violation of these obligations may result to the removal of the job posted or the removal of the Account as MINISTRY OF PIANO may determine.
TRANSACTION:
MINISTRY OF PIANO may deduct certain fees upon payment to the Seller. MINISTRY OF PIANO process the transaction between the Buyer and the Seller.
CONDUIT:
MINISTRY OF PIANO are not parties to, have no involvement or interest in, make no representations or warranties as to, and have no responsibility or liability with respect to any communications, transactions, interactions, disputes or any relations whatsoever between YOU and other USERS, person or organization. YOU must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research or due diligence with respect to your interactions with others. This excludes communication between MINISTRY OF PIANO AND YOU.
ELIGIBILITY:
MINISTRY OF PIANO services is available only to legal entities and persons who are at least eighteen (18) years old and are otherwise capable of forming legally binding contracts under applicable law.
SECURITY:
YOUR username and password cannot be shared with or used by anyone other YOU. YOU agree that you will not provide anyone else other than their access to the MINISTRY OF PIANO’s website via username and password. If YOU do not have a valid username and password, then YOU are not authorised to use or access password in the website protected areas.
ACCOUNT:
YOU are not allowed to use no more than one account to post or offer its services. YOU may not create or use additional accounts for the purpose of circumventing technological restrictions (security measures) in the posting process or bypassing MINISTRY OF PIANO security measures.
YOU may create an account, only on YOUR own behalf. YOU must not permit, enable, induce or encourage others to create accounts for YOU. The creation of accounts for others is expressly prohibited. YOU must only use YOUR own account, and may not use any account of another.
ACCOUNT MAINTENANCE FOR SELLERS:
Accounts of Inactive sellers might be deactivated in order to ensure the competitiveness and up-to-date information provided to visitors. Sellers need to ensure the accuracy of items posted including the stock availability. The minimum listing is 1 product.
WARRANTY:
Warranty, shipping, returns and refunds are solely at the discretion of the Sellers, however, MINISTRY OF PIANO may receive feedback and may take action where deem necessary.
LICENSE:
YOU hereby grant MINISTRY OF PIANO to use, display or publish the images, videos or ads posted on our website.
TERMINATION OF ACCOUNT:
MINISTRY OF PIANO, at our discretion reserves the right to refuse, suspend or terminate an account of any individual at any time without prior notice, unless otherwise stated.
NO GUARANTEE:
MINISTRY OF PIANO does not guarantee continuous, uninterrupted access to the Site, and operation of the Site may be interfered with by numerous factors outside MINISTRY OF PIANO’s control.
HOLD HARMLESS:
YOU agree to indemnify and MINISTRY OF PIANO harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of your interactions with others. This indemnification obligation includes payment of any attorneys’ fees and costs incurred by MINISTRY OF PIANO.
VARIATION OF TERMS AND CONDITIONS:
MINISTRY OF PIANO reserves the right to amend/update the terms and conditions herein at its sole discretion without prior notice to the Users. We advise Users to visit and review the current Terms & Conditions that apply to your transactions. If you do not agree to the terms, please do not use our Site. Your continued use of the Site following the posting of changes to the terms will be deemed your acceptance of those changes.
APPLICABLE LAWS:
This Term and Condition shall be governed by Singapore laws applicable therein.
ENTIRE AGREEMENT:
These terms and conditions constitute the entire agreement between YOU and MINISTRY OF PIANO in relation to your usage of this Site. No additional provisions are expressed nor implied. This AGREEMENT supersedes any all previous oral and/or written, express and/or implied agreements. By using any of our services, YOU HAVE READ AND FULLY UNDERSTOOD THIS AGREEMENT, and ACCEPTS ALL TERMS, CONDITIONS, COVENTANTS AND RESTRICTIONS, and WITHOUT EXCEPTION.
